1. Your agreement with us

These terms govern your access to PixieMatch’s website, albums, face-search tools, purchases, and creator services. By creating an account or using the service, you agree to these terms and our Privacy Policy. If you use PixieMatch for an organisation, you confirm that you can bind that organisation.

2. Accounts and eligibility

You must provide accurate information, keep your login details secure, and promptly tell us about unauthorised access. You are responsible for activity under your account. You must be legally able to enter this agreement; minors may use the service only with permission and supervision where required by law.

3. Acceptable use

You may not use PixieMatch to:

• upload or distribute unlawful, exploitative, intimate, violent, deceptive, infringing, or privacy-invasive content;
• harass people, impersonate others, scrape albums, or misuse face search;
• bypass access, payment, download, or security controls;
• introduce malicious code or disrupt the service; or
• use another person’s image or personal information without a lawful basis.

4. Your content and responsibilities

You keep ownership of content you upload. You give PixieMatch a limited, worldwide, non-exclusive licence to host, process, resize, moderate, display, and deliver that content only to operate and improve the service. The licence ends when the content is deleted, except for reasonable backups and records we must retain.

Photographers and organisers confirm they have the rights, permissions, and lawful basis needed to collect and publish content, including notices or consent required for children and for face-search features. Guest uploads are also subject to our Guest Upload Terms.

5. Purchases, fees, and payouts

Prices, taxes, platform fees, settlement periods, and payout requirements are shown before the relevant transaction. Paid access is provided only after payment confirmation. Creators are responsible for their pricing, payout details, and applicable taxes. We may delay a payout while investigating fraud, chargebacks, disputes, or a breach of these terms.

Except where the law requires otherwise or the content is materially unavailable, completed digital-photo purchases are generally final. Approved refunds are returned through the original payment method where possible.

6. Moderation, removal, and suspension

We may review, hide, restrict, or remove content and suspend or close accounts when reasonably necessary to enforce these terms, protect users, respond to reports, or comply with law. We may preserve relevant evidence and cooperate with lawful requests. Where appropriate, we will explain our decision and offer a way to contact us.

7. Service availability and third parties

We work to keep PixieMatch available, but the service may occasionally be interrupted, changed, or discontinued. Integrations and payment services are operated by third parties and may have their own terms. Face-search results and automated moderation can be inaccurate and should not be treated as definitive decisions about a person.

8. Disclaimers and liability

PixieMatch is provided on an “as available” basis to the extent permitted by law. We do not exclude liability that cannot legally be excluded. Otherwise, we are not responsible for indirect or consequential loss, lost profits, or content uploaded by users. Our total liability relating to the service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

9. Ending your use

You may stop using PixieMatch or request account closure at any time. Terms that by their nature should continue—including payment obligations, licences needed for prior delivery, disclaimers, and dispute provisions—survive closure.

10. Governing law, changes, and contact

These terms are governed by the laws of Kenya. The courts of Kenya will have jurisdiction, subject to any consumer rights that require a different process. We may update these terms and will provide reasonable notice of material changes. Questions can be sent to hi@pixiematch.com.
